A/N: written for wingswing 2006 (if you don't know what that means: I chose Roslin, and a female West Wing character to pair her with was randomly assigned to me). Evelyn Baker Lang (Glenn Close) is nominated as Chief Justice of the Supreme Court in the season 5 episode "The Supremes." everything else is obviously an AU (which I'd invite others to come and play in). all text is original with the exception of a little Shakespeare and the Supreme Court quotations and decision, which is lifted in large part from Hamdi v. Rumsfeld (it's for ambiance -- don't feel you need to read the entire thing). the other web sites phished are MSNBC, The Smoking Gun, and Wonkette. West Wing cap courtesy of spectralsoul. section titles are, of course, from the Bill of Rights and 14th Amendment. it all started because in the shower a few weeks ago I listened to the This American Life program "Habeas Schmebeas" [ audio / transcript ].
summary: the Great Writ of habeas corpus allows the Judicial Branch to play a necessary role in maintaining this delicate balance of governance, serving as an important judicial check on the Executive's discretion in the realm of detentions. (Justice O'Connor, Hamdi v. Rumsfeld)
